No they will not face any issue for OC because 75m NGT rule is not applicable to them

I am considering this project but still have some doubts or concerns ……
I was just going through all the reviews again, someone is saying about 30 meter lake buffer zone and the person is claiming that he actually sat with CEO and found that tennis court and few other amenities are falling withing this 30 meter buffer zone. What do you think about this, will there be any risk? Did you get a chance to see the plan and details around lake buffer zone?

As such the buffer zone should be kept free from any construction activity (non-construction zone) so if the authority objects then, yes there seems bit concern about the same.
Location of the property is very good but can’t say now anything on the amenities part.

I have a question related to NGT/Raja Kaluve ,
– I know Vaswani got an approval before May 2016 but lets consider a far life event, building is due for reconstruction in 25 years so again there will be new permission from NGT and at that time NGT may not give permission as per current rule. With this point in mind do you think there will be a problem in resale?
I am also considering Godrej United as an option, what will you suggest between Godrej United and Vaswani Exquisite?

As per our views, It will be under redevelopment sanction process not on the new development, so even at that point, current NGT norms shall not be applicable.
Both the projects are equally good, where as you get only 3 & 4 bhk options in Exquisite and the segment will of niche; but in United all the options like 1, 2, 2.3, 3 & 4 BHK are available so suggest you to go with the one you get your preferred choice of unit.

As we got to know that, The plan for the project in terms of vertical is 24 floors, but currently the bookings are open till 16th floor as they are awaiting clarity on TDR, as this additional floors are based on the TDR approvals from BDA., But the structural design is planned for 24 floors whether they would receive the approvals for 24 floor or 16 floors which doesn’t matter.
Normally builder would keep the set of legal documents which needs to be vetted from the lawyers of resp home buyers, that would usually consist of Title Opinions, Mother deeds, Latest EC, Competent Approvals documents from BDA, BWSSB, Environmental pollution boards, Bescom, Airport authority, BSNL, conversion orders etc.., you can get all the details documents from the builder team to get scrutinised with your lawyer and further if any missing document needed, your lawyer can ask and assist you with the same.

This site says delivery 2018 onwards, whereas the builder is now quoting 2019 end. Does this mean that the project is already delayed? Are you aware if the project is moving ahead at the committed pace?

It is said 42 months from the date of commencement certificate, so its wrongly addressed regret for the same. So appx date of completion would be 2019 end Plus 3 to 4 months buffer period can be considered

The boundary of the project including tennis court etc. is within 30 m zone already … can boundary wall itself can be technically demolished since it falls within 30 m lake buffer zone ? … can you also tell me which document/order clearly mentions that projects already launched don’t need to conform to 75 m rule ? We suggest you to please recheck with the builder on the tennis court area falling under 30 m zone. kindly check in the public media news for the retrospective approved projects.
I checked project plan by sitting with CEO..Yes tennis court.. Basketball ball , jogging track Fall under 30 MTs lake buffer zone. Ideally it sud be greenery with boundary wall open towards lake fir to get oc. With all dis we will get only our house area car parking n club amenities..Not able to take decision on dis project even if dey quote less price becoz of above flaws.
Huge concern about the project … New NGT tribunal guideline is 75 metres from lake boundary should be no construction zone compared to 30 m earlier … there will be no place construct if 75m is imposed … since land parcel itself is small …

Need not to worry, New NGT norm is applicable only for project which yet launch or receive approvals from BDA & BBMP. Not applicable for projects which are already launched and received approvals form Govt Authorities like Vaswani Exquisite.
