Hi Harish, I am a second time investor Purva.
I am disappointed this time with Purva Zenim. There is no progress on the project last 4 months, no construction happening. Not sure of the the project issues. When i called they told me curing in progress. Not sure why curing takes 4 months.
There is no price appreciation for last 2 years. Everything is blamed on Covid, i invested in other grade A properties which are doing fine. I think Purva is severely impacted and could not manage covid well. They say with Maven technology they will cover by sending 2 payment invoices in a month once they start(!!!!!)..
Do you think exit from this project is a better decision than to continue. Please advise.

We have already booked a flat in purva zenium. However, in their agreement of sale document nothing is mentioned about the UDS. When asked they said they cannot mention it now as the all the phases are not over. We are little concerned about this aspect. What would you suggest? Shall we go ahead with signing the agreement?

Do not worry you can proceed with the signing.
It is the discretion of the builder and the developer does not retain any ownership rights over that land in any manner whatsoever. This can be understood better by understanding Sec. 4 (Status of Apartments), Sec. 6(2) (Common Areas and Facilities), and Sec. 3(f) (Definition: Common Areas and Facilities) of the KAOA.
Whilst Sec. 4 confirms that each apartment is the heritable (dictionary: capable of being inherited) and transferable immovable property of the owner; it also states that a proportionate undivided interest in the common areas and facilities are deemed to be a part of the apartment sold and purchased.
Sec. 6(2) clarifies this further by stating that such undivided interest in the common areas and facilities shall not be separated from the apartment, and are deemed to have been conveyed even if the agreement for sale or sale deed do not expressly state or mention its area or percentage.
When read together, it becomes apparent that by selling and purchasing an apartment unit, the actual area of the apartment along with a certain proportionate UDS are transferred to each and every owner of an apartment; whether or not an agreement of sale or sale deed actually states it.
Besides, Each owner’s proportionate percentage of UDS will be stated in the deed of declaration for the apex association of owners, once it is formed.
Is this better than brigade orchards ? The latter is affordable
